Terms of Service
The rules and guidelines that govern your use of TenderWatch.
1. Acceptance of Terms
By accessing and using TenderWatch ("the Site"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.
2. Description of Service
TenderWatch monitors published UK public-sector procurement notices and sends you email digests of tenders matching the sectors and keywords you choose. We offer a free plan and paid subscription plans as described on our pricing page.
3. Accounts
3.1 Account Creation
- You must provide a valid email address to create a watch or an account
- We sign you in with emailed links; there is no password. You are responsible for keeping access to your email account secure
- You must notify us immediately of any unauthorised use of your account
- You may not impersonate others or provide false information
3.2 Account Termination
You may unsubscribe from emails at any time using the link in any digest, or ask us to delete your account entirely. We reserve the right to suspend or terminate accounts that violate these terms.
4. Plans and Payment
- Paid plans are recurring monthly subscriptions billed through Stripe at the prices shown on our pricing page
- You can cancel at any time through the billing portal; your plan remains active until the end of the current billing period
- We do not offer pro-rata refunds for partial billing periods (see Section 11 for exceptions)
- We may change plan prices with at least 30 days' notice by email; changes apply from your next billing period
5. Tender Information
Tender notices on TenderWatch are sourced from official public procurement feeds and are provided for your convenience only.
- We do not guarantee the accuracy, completeness, or timeliness of any tender notice, match, or alert
- Notices may be amended or withdrawn by the publishing authority after we index them; always verify details against the official published notice before acting on it
- We are not responsible for opportunities missed because a notice was not indexed, not matched to your watch, or an email was not delivered
- We are not affiliated with, or endorsed by, any contracting authority or official procurement portal
6. User Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorised access to the Site or other users' accounts
- Scrape, spider, or use automated tools to bulk-access the Site without permission
- Resell, redistribute, or republish the alert service or substantial portions of the Site's content
- Circumvent any security features or plan limits of the Site
- Upload viruses, malware, or malicious code
7. Intellectual Property
The Site, including its design, logo, text, graphics, and functionality, is owned by TenderWatch and protected by copyright, trademark, and other intellectual property laws. Tender notice content originates from the publishing contracting authorities and remains subject to the terms under which it was published.
8. Third-Party Services
The Site integrates with third-party services (Stripe for payments, Postmark for email, and others). Your use of these services is subject to their respective terms of service and privacy policies.
9. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that you will find or win any contract through the Site. We are an alerting service, not a procurement adviser, bid writer, or agent.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENDERWATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use the Site
- Any missed, delayed, inaccurate, or incomplete tender notice, match, or alert
- Any unauthorised access to or use of our servers and/or any personal information stored therein
- Any bugs, viruses, or other harmful code transmitted through the Site
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR £50, WHICHEVER IS GREATER.
11. Refund Policy
Subscription fees are non-refundable, except in the following circumstances:
- A technical issue on our side prevents delivery of your digests for more than 7 consecutive days
- We terminate your account due to our error (not a terms violation)
Refund requests must be submitted within 30 days of the issue occurring by emailing [email protected].
12. Indemnification
You agree to indemnify, defend, and hold harmless TenderWatch from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last updated" date. Your continued use of the Site after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
